Nous sommes au II<sup>e<\/sup>\u00a0si\u00e8cle av. J.-C., et le <a href=\"https:\/\/www.persee.fr\/doc\/ridc_0035-3337_1991_num_43_3_2308\">premier cas de contrefa\u00e7on<\/a> vient de faire son apparition.<\/p><p>La contrefa\u00e7on, pire ennemi du march\u00e9 de l\u2019industrie du <a href=\"https:\/\/theconversation.com\/fr\/topics\/luxe-34482\">luxe<\/a>, est partout et \u00e0 tous les niveaux.<\/p><p>En 2020, la valeur des marchandises saisies aux fronti\u00e8res de l\u2019Union europ\u00e9enne s\u2019est \u00e9lev\u00e9e \u00e0 <a href=\"https:\/\/www.paragon-id.com\/fr\/inspiration\/la-contrefacon-dans-le-secteur-du-luxe-defis-et-solutions\">778\u00a0millions d\u2019euros<\/a>. <a href=\"https:\/\/theconversation.com\/fr\/topics\/industrie-de-la-mode-103977\">L\u2019industrie de la mode<\/a> est particuli\u00e8rement touch\u00e9e. Le march\u00e9 de la mode contrefaite est \u00e9valu\u00e9 \u00e0 <a href=\"https:\/\/www.voguebusiness.com\/fashion\/how-independent-brands-are-resisting-counterfeits\">464\u00a0milliards de dollars<\/a> en 2019 et les pertes de ventes de mode li\u00e9es aux produits contrefaits ont atteint <a href=\"https:\/\/www.statista.com\/statistics\/1117921\/sales-losses-due-to-fake-good-by-industry-worldwide\/\">26,3\u00a0milliards d\u2019euros<\/a> dans le monde en 2020.<\/p><p>Les effets \u00e9conomiques n\u00e9gatifs de la contrefa\u00e7on, comme les pertes d\u2019emploi et les pertes de revenus, sont aujourd\u2019hui <a href=\"https:\/\/ideas.repec.org\/a\/eee\/jbrese\/v69y2016i10p4249-4258.html\">bien connus<\/a>. Un rapport de l\u2019UE en 2015 montrait que <a href=\"https:\/\/euipo.europa.eu\/ohimportal\/en\/web\/observatory\/ip-infringements_clothing-accessories-footwear\">365\u00a0000 emplois directs<\/a> avaient \u00e9t\u00e9 perdus \u00e0 cause de la contrefa\u00e7on. Et les impacts n\u00e9gatifs ne sont pas qu\u2019\u00e9conomiques, ils sont aussi humains\u00a0: <a href=\"https:\/\/fr.fashionnetwork.com\/news\/Julio-laporta-la-contrefacon-n-est-pas-un-crime-sans-victime-,1422261.html\">travail forc\u00e9, cybercriminalit\u00e9, financement du terrorisme<\/a>, <a href=\"https:\/\/lescoulissesdelacontrefacon.weebly.com\/conseacutequences-et-risques.html\">probl\u00e8mes de sant\u00e9<\/a> et <a href=\"https:\/\/www.ingentaconnect.com\/content\/mcb\/096\/2011\/00000020\/00000005\/art00005\">perte de confiance et d\u2019estime de soi<\/a> chez les consommateurs.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-0af8348 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"0af8348\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-710d864\" data-id=\"710d864\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-5021a3d elementor-widget elementor-widget-text-editor\" data-id=\"5021a3d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h2>Exp\u00e9riences contrast\u00e9es<\/h2><p>Acheter ou vendre un article contrefait est ill\u00e9gal. En France, un <a href=\"https:\/\/www.economie.gouv.fr\/dgccrf\/Publications\/Vie-pratique\/Fiches-pratiques\/La-contrefacon\">acheteur de contrefa\u00e7on<\/a> se verra confisquer l\u2019article et devra payer une amende d\u2019une valeur entre une et deux fois le prix de l\u2019article contrefait. La sanction des <a href=\"https:\/\/www.economie.gouv.fr\/dgccrf\/Publications\/Vie-pratique\/Fiches-pratiques\/La-contrefacon\">vendeurs ou d\u00e9tenteurs d\u2019articles contrefaits<\/a> peut aller jusqu\u2019\u00e0 300\u00a0000 euros d\u2019amende et trois ans de prison. Malgr\u00e9 ce cadre l\u00e9gal, le march\u00e9 de la contrefa\u00e7on reste dynamique, notamment en raison de la <a href=\"https:\/\/ideas.repec.org\/a\/eee\/joreco\/v62y2021ics0969698921001624.html\">digitalisation de la consommation<\/a> et de l\u2019engouement des consommateurs pour le <a href=\"https:\/\/hapticmedia.com\/blog\/fr\/le-march%C3%A9-du-luxe-en-chiffre\/\">march\u00e9 du luxe<\/a>.<\/p><p>Outre un renforcement des solutions l\u00e9gales et douani\u00e8res, de nouvelles <a href=\"https:\/\/www.hbrfrance.fr\/chroniques-experts\/2019\/05\/26022-comment-mieux-combattre-la-contrefacon\/\">solutions technologiques<\/a> se sont pourtant d\u00e9velopp\u00e9es\u00a0: blockchain, Internet des objets, traceurs chimiques, hologramme. Des start-up, telles que <a href=\"https:\/\/www.veworld.com\/home\">vechain<\/a> et <a href=\"https:\/\/www.arianee.org\/\">arianee<\/a> se sont empar\u00e9es de ces solutions pour aider les marques de luxe \u00e0 lutter contre la contrefa\u00e7on.<\/p><p>Dans contexte, notre \u00e9quipe de recherche a r\u00e9cemment finalis\u00e9 un article acad\u00e9mique (\u00e0 para\u00eetre) ayant pour but de mieux comprendre les raisons et l\u2019impact psychologique de l\u2019achat de la contrefa\u00e7on de mode de luxe. 10 participants, 2 hommes et 8 femmes, tous europ\u00e9ens et \u00e2g\u00e9s entre 20 et 34\u00a0ans, ont pris part au projet. Chaque participant a r\u00e9alis\u00e9 un entretien individuel pour mieux comprendre ses habitudes d\u2019achat de contrefa\u00e7on et sa perception de la contrefa\u00e7on de mode de luxe.<\/p><p>[<em>Plus de 80\u00a0000 lecteurs font confiance \u00e0 la newsletter de The\u00a0Conversation pour mieux comprendre les grands enjeux du monde<\/em>. <a href=\"https:\/\/theconversation.com\/fr\/newsletters\/la-newsletter-quotidienne-5?utm_source=inline-70ksignup\">Abonnez-vous aujourd\u2019hui<\/a>]<\/p><p>L\u2019\u00e9tude a identifi\u00e9 des exp\u00e9riences contrast\u00e9es\u00a0: alors que certains participants ont achet\u00e9 impulsivement et ont ensuite regrett\u00e9 leur d\u00e9cision, d\u2019autres ont soigneusement examin\u00e9 leur achat et ont finalement \u00e9t\u00e9 satisfaits de leur achat.<\/p><p>La premi\u00e8re cat\u00e9gorie regroupe des acheteurs plut\u00f4t \u00ab\u00a0impulsifs\u00a0\u00bb ont expliqu\u00e9 avoir achet\u00e9 leur article contrefait sur \u00ab\u00a0un coup de t\u00eate\u00a0\u00bb, ayant \u00e9t\u00e9 attir\u00e9 par la ressemblance imm\u00e9diate de l\u2019article contrefait avec une <a href=\"https:\/\/theconversation.com\/fr\/topics\/marques-39209\">marque<\/a> de luxe, ou parce que leur achat avait \u00e9t\u00e9 en ligne et donc tr\u00e8s rapide et peu r\u00e9fl\u00e9chi. Ces acheteurs ont exprim\u00e9 un vif regret tr\u00e8s peu de temps apr\u00e8s l\u2019achat. Ce regret est coupl\u00e9, et m\u00eame peut \u00eatre expliqu\u00e9, par une prise de conscience \u00e9thique et \u00e9cologique, comme l\u2019illustre le t\u00e9moignage suivant\u00a0:<\/p><blockquote><p>\u00ab\u00a0En achetant de la contrefa\u00e7on, je nourris la pauvret\u00e9. J\u2019ai l\u2019impression de soutenir le travail ill\u00e9gal en achetant de la contrefa\u00e7on. [\u2026] Je me sentais coupable en raison de l\u2019impact de la contrefa\u00e7on, de la cha\u00eene d\u2019approvisionnement non s\u00e9curis\u00e9e, du travail des enfants, etc.\u00a0\u00bb<\/p><\/blockquote><p>Ces participants ont ressenti une telle culpabilit\u00e9 et une telle honte qu\u2019ils ont d\u00e9clar\u00e9 ne plus vouloir acheter de <a href=\"https:\/\/theconversation.com\/fr\/topics\/contrefacon-42995\">contrefa\u00e7on<\/a>. Ils expliquent m\u00eame partager ce sentiment avec d\u2019autres consommateurs pour les convaincre de ne plus acheter de contrefa\u00e7on.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-1057fa5 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"1057fa5\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-6631efa\" data-id=\"6631efa\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-155883f elementor-widget elementor-widget-text-editor\" data-id=\"155883f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h2>Un pied de nez \u00e0 l\u2019industrie<\/h2><p>Contrairement \u00e0 ces acheteurs \u00ab\u00a0impulsifs\u00a0\u00bb, les autres participants ont une approche diff\u00e9rente de leurs achats de contrefa\u00e7on. Ces participants examinent soigneusement et de mani\u00e8re non impulsive les articles de contrefa\u00e7on. Ils ont d\u00e9velopp\u00e9 une expertise et une connaissance pour trouver de la contrefa\u00e7on de qualit\u00e9 et d\u2019une grande ressemblance avec les articles de luxe.<\/p><p>Alors que les participants \u00ab\u00a0impulsifs\u00a0\u00bb ach\u00e8tent des articles contrefaits \u00e0 faible prix (entre 5 et 20 euros), ces participants \u00ab\u00a0experts\u00a0\u00bb sont pr\u00eats \u00e0 payer un article contrefait plus cher (entre 20 et 400 euros) tant que la qualit\u00e9 de l\u2019article est garantie. Ces acheteurs \u00ab\u00a0experts\u00a0\u00bb estiment notamment que leurs achats constituent un pied de nez \u00e0 l\u2019industrie de luxe, comme l\u2019illustre le t\u00e9moignage d\u2019un participant\u00a0:<\/p><blockquote><p>\u00ab\u00a0Les marques de luxe nous manipulent. La qualit\u00e9 n\u2019est pas si bonne que \u00e7a. Je ne le trouve pas \u00e9thiquement correct. Je sais ce que co\u00fbte vraiment le produit, et les marques de luxe augmentent tellement le prix, c\u2019est trop et \u00e7a n\u2019en vaut pas la peine.\u00a0\u00bb<\/p><\/blockquote><p>Notre \u00e9tude montre donc que la perception des consommateurs concernant l\u2019aspect <a href=\"https:\/\/theconversation.com\/fr\/topics\/ethique-20383\">\u00e9thique<\/a> du monde du luxe est le pivot dans la finalisation d\u2019un achat de contrefa\u00e7on. Alors que certains consommateurs culpabilisent d\u2019avoir achet\u00e9 de la contrefa\u00e7on qu\u2019ils consid\u00e8rent non \u00e9thiques, d\u2019autres consommateurs consid\u00e8rent l\u2019industrie de luxe et ses politiques de prix comme non-\u00e9thique, ce qui les am\u00e8ne \u00e0 consommer de la contrefa\u00e7on.
